Case Description
Representation of the client as respondent in a Supreme Court appeal. The appellant, who had sought to purchase a luxury villa from the client, claimed to have transferred NIS 1.6 million in cash and demanded its return after the deal was canceled. The Tel Aviv District Court dismissed the claim.
In the appeal, we argued that a comprehensive waiver clause applied to all amounts transferred between the parties, including cash payments not explicitly mentioned in the agreement. The Supreme Court accepted our position and issued a precedent-setting ruling (Judge Grosskopf), holding that when both explicit and implicit understandings exist, they are to be interpreted under the principles of private contract interpretation, based on the parties’ intent.
